    What to Do after a Workplace Injury

    Your employer should take care of you after an on-the-job industry, in many cases, but sometimes you have to fight for your rights. A workplace injury can be a complicated event, and it may draw in management, coworkers, the Human Resources department, and even lawyers. How do you ensure that your injuries are covered and you are justly compensated?

    There are some steps you need to take following a workplace injury, and we will cover those here so that you have everything in place on your side. You cannot control what your employers do, and it is often difficult to tell whether the law is on your side in cases like this if you know little to nothing about workplace injury law.

    Report What Happened

    Even if the injury seems minor, it should be reported. Let your boss know about the injury, with all the details provided. If you feel fine, you should still ask your employer if you should go get checked out by a doctor. This shows your willingness to follow their instructions.

    By reporting to your employer about the incident, you are bringing the injury out in the open. You avoid having to come back later with complaints over the injury and your boss not having any knowledge that something happened. By reporting right away, you demonstrate honesty and a willingness to do the right thing for your employers and according to the law.

    Write Down the Details

    If you have to share your story later on with someone, then you may not remember some of the details very well. The date, the names of those involved, the time it happened, and what you were doing at the time of the injury are all important. You may have to repeat this information to your boss, to a lawyer, or to a doctor at a later time, and the details could become fuzzy.

    So, write it all down so that you don’t have to rely on your memory. Make a note of even things that don’t seem important like what you were wearing at the time of the incident and what you did immediately before and after the injury happened. As part of your efforts to record what happened, you should also take pictures of the area where the injury occurred. Have a coworker help you so that the pictures include yourself positioned in the exact spot that the incident occurred, if it is safe to do so.

    It is also a good idea to take statements from coworkers who can help flesh out the story and provide their input. This is something a personal injury lawyer would assist with, in many cases, but getting accurate statements from coworkers can be more difficult as time progresses. It is better to put those statements down on paper or in a voice note as quickly as possible for the sake of accuracy.

    Keep Your Paperwork

    As you report the injury and are seen by a doctor, you will have to fill out paperwork. Your employer may have you complete a form, and your doctor will have you fill some forms as well. You should get copies of all these forms for your personal records.     Any medical bills, doctor’s reports, and other forms that you fill out should all be kept in your files. Anything you have to pay related to your injury could be covered by your employer later on, and this step simply makes that process of repayment easier and eliminates questions about how much each expense was.

    See a Doctor

    Even small injuries warrant a visit to the doctor. What may seem small at first can become much more serious later on. You might think that the injury is no big deal, but the symptoms you experience in the following days and weeks could become distressing. If you didn’t bother to see the doctor when the injury happened, then there will be a question as to whether the suffering you are experiencing is from the injury at work or from some other source.

    If your employer recommends that you don’t bother with a doctor, you may still want to insist that you visit one. Your employer will not know how you feel and what you are personally experiencing, so ultimately the judgement call to see a doctor or not comes down to you.

    Talk to a Lawyer

    If you believe the injury is a serious one and it may keep you back from work, then start looking for a lawyer. That doesn’t mean you have to contact one and that you need to get a lawyer working on your claim right away. But you should know what your options are and be able to reach out to a lawyer quickly if the problem worsens.

    You should also consult a lawyer if you have suffered a workplace injury that your employer is refusing to cover. If your workplace is not going to take care of you in providing time off from work to cover and is not going to cover the cost of specialist visits that you may need, then it is wise to get in touch with a personal injury lawyer. This is how you protect yourself and ensure that you get the help you need in your time of crisis.

    If you have done all the steps we have listed already, then you should be covered on your end. Your lawyer can take over from there and make sure that you are compensated for the injury. The lawyer can also help you to smooth things over with your employer so that you can retain a good working relationship with them through the injury claim.
