Treatments using CBD-based oils are rapidly being popular as oil formulation has higher bioavailability and ease of administration. But have CBD oils been accepted everywhere in Europe? If so, do laws differ amongst countries? Let’s find out.

In this article, we will discuss the types of CBD, how to choose and market the best CBD oils, as well as legal aspects that you must consider before adding CBD to your product line.

Legal Status Of CBD OiIs in European Countries

CBD oil is a popular wellness product that is derived from the cannabis plant. It has gained popularity in recent years due to its potential therapeutic benefits, such as pain relief, anxiety reduction, and improved sleep. However, the legality of CBD oil in Europe varies depending on the country. This is because some countries have more relaxed regulations on the sale and use of CBD oil, while others have stricter laws.

In Europe, for instance, legislative changes have boosted access to hemp products, including CBD oil. However, there are strict rules and regulations that must be followed to produce and sell CBD oil legally. One of the main requirements is that the THC concentration in hemp in CBD oils must be less than 0.2%. THC is the psychoactive compound in cannabis that produces a “high” and is illegal in many countries.

Bulgaria was the first EU member state to grant a corporation permission to openly sell CBD products in 2019, and since then, many other European countries have followed suit. Currently, all European countries except for a few nations allow the consumption of CBD oils.

Sequoya Biotechnologies  is a leading processor, supplier, and manufacturer of high-quality CBD oil products in Europe. They are committed to excellence and have gained a reputation for being a pioneer in the CBD industry. Furthermore, Sequoya’s products are original and authentic, and they adhere to GMP (Good Manufacturing Practice) and EU HAACP (Hazard Analysis and Critical Control Points) laws.

Changes In CBD Oil Regulations And Availability in Europe

After hemp-derived CBD products were found to have medicinal and health benefits, they were recognized and, once they complied with INCI standards, they were seen as legal products which caused a significant shift throughout Europe.

Even though CBD may be acknowledged as a Novel Food by 2022, it had to go through a registration process with the European Food Safety Authority (EFSA) in order to be recognized as the Novel Food throughout the EU. 19 applications to the EFSA for new food status for CBD products had been submitted as of Q2 of 2022. By November 2022 not a single application had been finished since EFSA determined that further evidence was necessary to fully understand any potential negative effects of hemp.

A new CAP went into force in Europe on January 1st, 2023. One of the foundational pieces of contemporary Europe is the Common Agricultural Policy (CAP), which establishes accepted norms for the importation of particular agricultural goods into Europe’s single market as well as the guidelines and requirements for the advantages that farmers may be eligible for when producing certain crops, like hemp.

The biggest change compared to the preceding CAP is that the allowed THC level in crude imported hemp is now set at 0.2%. Additionally, farmers in Europe are qualified for incentives and other advantages for growing hemp.

In many European countries, hemp is seen with the same extreme hostility as illegal narcotics. Fortunately, things have improved in this area recently, telling investors that the CBD oil market is a potentially profitable one.

Sequoya produces a wide range of CBD products, all of which contain trace amounts of THC in compliance with European laws. They are highly stable, fully odourless, and have a crystal-white colour. They can be applied in a wide range of consumer goods, such as cosmetics, food and beverages, nutraceuticals, and pharmaceuticals, making them incredibly adaptable.

Another CBD product from Sequoya is CBD Distillate, which is highly concentrated and ranges in CBD content from 65% to 85% while retaining the plant’s inherent terpenoids and other chemicals to produce clear gold CBD Oil. This provides a nice balance of a cannabinoid-rich product that complies with laws in all of Europe.

Prescription Requirements For  CBD Oils In Europe

CBD oils have gained acceptance for their potential therapeutic properties, leading to the modification of laws in many countries to permit the use of hemp-derived products. Europe has been a leader in this regard, with many countries moving towards harmonizing regulations regarding CBD.

Prescription requirements for CBD oils in European pharmacies vary by country. In Austria, for example, CBD oil can potentially be sold if marked as not intended for human consumption, while in Belgium, it is still widely available in shops despite being technically illegal.

In Bulgaria and Croatia, CBD oils are legal as long as they contain less than 0.2% THC, while in the Czech Republic, legal hemp products are those that contain less than 0.3% THC. Despite some countries having stricter laws governing the sale of CBD oil, as of 2020, it is legal to purchase CBD oil in every European country.

Before CBD oils are approved for public consumption, they usually undergo third-party testing to ensure they meet regulatory requirements. Although some nations have strange laws or regulations that cast doubt on the legality of CBD, it is now possible to attempt to sell CBD oil in every European member country. However, before selling CBD oils in Europe, it is essential to conduct due diligence on the legal framework applicable in each nation as the recreational use of CBD products remains uncharted waters.

According to a 2022 report by market researchers Prohibition Partners, sales of CBD products in Europe are projected to increase to almost €2.6 billion by 2026. The increasing popularity of CBD oils and other products is a clear indication of the potential therapeutic benefits of hemp extracts.
