Indian gambling laws and regulations are one of the most complicated in the world. In this article, we will be exploring all the different factors that impact the legality of online gambling in India.

Whether you’re gambling at some of the best betting sites in India like this page or you’re simply gambling for fun, there are a few factors that you need to consider when gambling online in India. These factors include laws, game types, and location.

    Gambling laws

The main factor in every country when it comes to gambling is the law. However, in the case of India, some laws and regulations come on a national level, and they are mostly considered as guidelines. This means that individual states have the power to regulate gambling. If you want to see if gambling is legal in India, you will first need to check the regulations in the state that you are residing in.

    Game type

When it comes to games, there are two main game types that the India laws and regulations recognise: skill games and luck games. Skill games are games that require knowledge, strategy, and skill. In certain Indian territories, gambling is legal if the games are those of skill. Games determined by luck are games in which the participants have no say or impact on their outcome, and they require no skill or knowledge for gamblers to become winners. They kinds of games are considered illegal in most of the country.

    Location

Indian gambling laws offer a lot of grey area including location. Since the current national-level law in India was created before the invention of the internet, the law does not mention online gambling. This means that the activity is not illegal in most of India, but traditional gambling is prohibited in most areas. That is why most Indian gamblers are turning online for their fun and games.

So, is online gambling legal or illegal?

Based on the above elements, India is a grey area when it comes to gambling laws and your best bet is to look at specific state laws about how gambling activities are treated. There are some interesting facts that are also conflicting. For example, horse betting is legal in the country since bettors need to possess prior skill to place these bets. However, at the same time, lottery is also legal which might not seem logical based on these rules. This kind of gambling is permitted in several states around India including Assam, Arunachal Pradesh, Maharashtra, Goa, Kerala, Punjab, Madhya Pradesh, Mizoram, Manipur, Meghalaya, Nagaland, West Bengal, and Sikkim.

According to the Public Gambling Act of 1976, the states of Goa, Nagaland, Sikkim, and Daman have banned traditional brick-and-mortar casinos and online gambling. Based on the Prevention of Gambling Act of 1887, gambling is also illegal in Maharashtra. However, e-gaming or luck games, as they are considered in the states of Nagaland and Sikkim, are allowed in these territories. On the other hand, skill games are legal in Arunachal Pradesh and Telangana regions based on the State Gaming Act of 1974.

    India’s illegal gambling

With so many restrictions, rules and regulations that prevent most types of gambling, the creation of black-market gambling was inevitable. Some reports claim that black-market gambling in India is a billion-dollar industry. Statistics even show that it is almost three times bigger than the legal market.

Online gambling is one of the fastest-growing industries in India. Many young Indians are enjoying the entertainment of placing bets online. If you looking to gamble in India, do your research thoroughly and check the state’s gambling laws beforehand to avoid disappointment.
