A north Powys catering establishment has been sanctioned by Powys County Council for commercial waste ‘duty of care’ offences, after waste from the business was found at the community recycling site in Back Lane car park, Newtown.
After an investigation and inspection of the businesses waste transfer notes, our waste enforcement team served the company with a £300 Fixed Penalty Notice and offered them appropriate remedial advice on how to ensure they lawfully dispose of their commercial waste in the future.
Every business, organisation and charity have a duty of care by law (Environmental Protection Act 1990, Section 34), to ensure that their waste and recycling is processed correctly and using recycling facilities provided for residents, such as the community recycling sites, contravenes this legislation.
The misuse of these domestic facilities creates extra costs for the council and can blight the area and overload the services which are provided wholly for the use of residents.” Explains Cllr Heulwen Hulme, Cabinet Member for Recycling and Waste. “Businesses caught using the community recycling sites illegally will be fined and may face prosecution.
“Commercial organisations, no matter how small, are required by law to pay for the collection and disposal of their waste and recycling by a registered waste carrier, as well as keeping receipts and waste transfer notes for a minimum of two years.
“We have a dedicated team of commercial recycling staff who can help businesses ensure they comply with regulations whilst doing their bit for the environment by recycling as much of their waste as possible.”
